Terms of Service

These Terms of Service ("Terms") are an agreement between you and KnowBud ("KnowBud", "we", "us") and govern your use of the KnowBud mobile app and related services (the "Service"). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Service.

1. Eligibility

You must be at least 18 years old to use the Service. By using KnowBud you confirm that you meet this requirement and that the information you provide is accurate.

2. Your account

Some features require an account. You are responsible for keeping your login credentials secure and for all activity under your account. Tell us promptly at [email protected] if you suspect unauthorised use.

3. The Service

KnowBud delivers short, voice-first and guided AI learning sessions. The Service is currently in beta and is provided on an evolving basis — features may change, and we may add, modify, suspend, or discontinue parts of the Service at any time. We aim to give reasonable notice of significant changes.

4. AI-generated content

KnowBud's lessons and responses are generated by artificial intelligence. We work hard to ground the content in reliable sources, but AI-generated content can be incomplete or inaccurate and is not guaranteed to be correct. The Service is for general learning only and is not professional, medical, legal, or financial advice. Always verify anything important before relying on it.

5. Subscriptions and payments

The Service is currently free to use. If we introduce paid plans, they will be billed through the relevant app store (Apple App Store or Google Play) under that store's terms. Subscriptions renew automatically unless cancelled, and you can manage or cancel them in your app-store account settings. Except where required by law, payments are handled by the app stores and any refunds follow the store's policy.

6. Acceptable use

You agree not to: misuse the Service or interfere with its operation; attempt to access it by means other than the interfaces we provide; reverse engineer, scrape, or copy the Service except as permitted by law; upload or request unlawful, harmful, infringing, or abusive content; or use the Service to violate anyone's rights. We may suspend or limit accounts that breach these Terms.

These rules apply with particular force to journeys you publish to the community: published content must not contain profanity, hate speech, harassment, personal data about identifiable people, instructions for illegal activity, or spam or advertising. Published journeys are checked automatically at the moment of publishing, and other users can report them. We may unpublish or remove reported or non-compliant content at our discretion, and repeated violations may lead to suspension of publishing rights or of your account.

6a. Safe use and driving

KnowBud offers a hands-free, voice-first mode that can be used while your visual attention is elsewhere, including while driving. KnowBud is not a substitute for your full attention, and your safety and the safety of others always come first. You acknowledge that any activity while driving carries risk, and that you alone decide when and where it is safe and lawful to use the Service. You are solely responsible for operating your vehicle safely and for complying with all applicable laws, including traffic and distracted-driving laws in your jurisdiction. While driving, use only hands-free mode — do not look at, hold, or tap your device, and do not use the guided (visual) mode or any feature that requires reading or tapping. Pause the Service or stop your vehicle in a safe, lawful place if a session needs more attention than conditions allow. To the maximum extent permitted by law, and subject to §11, KnowBud is not liable for loss or damage arising from your decision to use the Service while driving or operating machinery.

7. Your content and custom journeys

You may provide inputs such as topics, goals, and answers, including when you create your own learning journeys ("Your Content"). You keep ownership of Your Content. You grant us a worldwide, non-exclusive, royalty-free licence to use, store, and process Your Content to operate, secure, personalise, and improve the Service. You are responsible for Your Content and confirm you have the right to provide it.

Publishing journeys. Journeys you create are private by default. A journey only becomes public through your explicit action — either by publishing it later, or by choosing at creation to share it with the community (on plans where part of the monthly journey allowance is community-shared, the app asks for this consent before the journey is created). When a journey is published, you additionally grant KnowBud and other users the right to view, and other users the right to learn from, its curriculum (title, description, and unit & lesson titles), in the app and on public pages of our website. Your personal motivation, background, and learner profile are never part of a published journey (see our Privacy Policy, §7). You can unpublish a journey at any time from the journey page, which withdraws this permission for new learners; learners who had already started keep access until they finish or leave it. If you delete your account, a journey you published stays in the catalogue, unlinked from you and with the personal parts you wrote erased (see our Privacy Policy, §9). We may unpublish content as described in §6.

Uploaded material. Where the Service lets you upload documents, images, or other material (for example to build courses from your own content), you must own that material or have the rights and permissions needed to upload it and to have courses generated from it. You are responsible for the content you upload, including for ensuring it does not infringe anyone's intellectual-property, privacy, or other rights. We may remove uploaded material that we reasonably believe violates these Terms or the law.

7a. Business and team use

If you use the Service on behalf of a company, organisation, or other legal entity (for example as an organisation admin creating or sharing courses for a team), you represent that you are authorised to act for that entity and to bind it to these Terms, and "you" includes that entity. Organisation admins are responsible for the material they upload on the organisation's behalf and for the invitations they issue. If KnowBud and your organisation have signed a separate agreement (such as an enterprise agreement or data-processing agreement), that agreement prevails over these Terms to the extent they conflict, for that organisation's use.

8. Intellectual property

The Service, including the app, its design, and the lesson content it generates, is owned by KnowBud or its licensors and is protected by intellectual-property laws. We grant you a limited, personal, non-transferable, non-commercial licence to use the Service for your own learning. You may not resell, redistribute, or commercially exploit the Service or its content without our permission.

Journeys and lessons are original educational works generated at your request. Where a journey or lesson refers to a book, an author, a publication, or a brand, the reference identifies the subject matter only. KnowBud and its content are not affiliated with, endorsed by, approved by, or sponsored by any referenced author, publisher, or other rights holder, and no such reference implies any partnership.

9. Third-party services

The Service relies on third-party providers (for example for authentication, speech-to-text, AI models, real-time audio, hosting, and analytics — see our Privacy Policy). We are not responsible for third-party services, and your use of them may be subject to their own terms.

10. Disclaimers

The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including fitness for a particular purpose, accuracy, or non-infringement, to the maximum extent permitted by law. We do not warrant that the Service will be uninterrupted, error-free, or that the content will be accurate or complete. Nothing in these Terms excludes liability that cannot be excluded by law.

11. Limitation of liability

To the maximum extent permitted by law, KnowBud will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising from your use of (or inability to use) the Service. Nothing here limits liability for death or personal injury caused by negligence, fraud, or any liability that cannot be limited under applicable law.

12. Indemnification

You agree to indemnify and hold KnowBud harmless from claims, damages, and expenses arising out of your misuse of the Service, your breach of these Terms, or your violation of any law or third-party right.

13. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you breach these Terms or if we discontinue the Service. Sections that by their nature should survive termination (e.g. intellectual property, disclaimers, limitation of liability) will survive.

14. Changes to these Terms

We may update these Terms from time to time. We will revise the "Last updated" date above and, for material changes, provide notice in the app. Continued use of the Service after changes take effect means you accept the updated Terms.

15. Governing law

These Terms are governed by the laws of the jurisdiction in which KnowBud is established, without regard to conflict-of-laws rules. Mandatory consumer-protection rights in your country of residence still apply.
